General Terms and Conditions of “insic GmbH” for Internet Users (End Customers)

These General Terms and Conditions of insic GmbH, Brookweg 6a, D-22941 Jersbek (hereinafter referred to as “insic”) apply to all contracts concluded by insic with end customers via the Internet.
They may be printed for later reference using the browser’s print function or downloaded and stored on the customer’s computer. They can also be accessed at a later time under the URL www.insic.de by selecting “AGB” (Terms & Conditions).


§ 1 General / Conclusion of Contract / Condition Subsequent / Scope / Changes

  1. insic provides internet users (hereinafter referred to as “User”) with its identification and age verification system including features for youth, consumer, player protection, and anti-money laundering. After successful registration, Users may prove their identity and legal age and gain access to internet offers (e.g., closed user groups) which require such verification.

  2. All services are provided exclusively on the basis of these Terms & Conditions. They also apply to future business relationships without further agreement. Conflicting terms from customers are expressly rejected.

  3. Side agreements, modifications, and amendments require written confirmation from insic. This also applies to the waiver of the written form requirement.

  4. insic reserves the right to amend these Terms & Conditions.

    • Customers will be informed of changes by email or upon login at the verified address.

    • They may object within one month of notification.

    • If no objection is made, the amended conditions continue to apply.

    • In case of objection, the contract continues unchanged, but insic may terminate the agreement.

  5. The contract is concluded:

    • online during registration by confirmation, or

    • with the email confirming receipt of registration information.

    Since only the sending, not the delivery of emails, can be guaranteed, the customer waives receipt of this message as a prerequisite for contract conclusion. The contract is concluded subject to the condition that registration cannot be successfully completed.


§ 2 Subject of the Contract

  • insic provides the User with an identification and age verification system as a prerequisite for access to third-party services and content that are legally restricted.

  • The products or services accessible via the system are not part of this contract.

  • By submitting personal data, the User authorizes insic to verify its accuracy, in particular identity and legal age.

  • Optionally, insic may conduct location checks if required by law.

  • Third-party verification services may be integrated; insic accepts no liability for the accuracy of such third-party data. The third-party’s contractual conditions may apply additionally.


§ 3 Authentication / Availability

The insic system is available in different variants depending on the medium:

  1. Software / Browser (“plug-in”)

    • A free software module is installed in the User’s browser or set-top box.

    • It generates a unique “key” for access to age-restricted content.

  2. Mobile Phone (mobile device)

    • The User’s mobile device is used as a “key” for access.

Availability:

  • insic guarantees an average availability of 97% per year up to the handover point to external network operators.

  • The operation of external networks and technologies is beyond insic’s control.

  • Maintenance and updates are not considered downtime.

Right to Amend:

  • insic may modify services or the technical environment if necessary to maintain performance, improve services, comply with legal requirements, or adapt to technical developments.


§ 4 Registration / Profile Changes / Self-Blocking

  1. Registration is only permitted for Users who are at least 18 years old.

  2. Users must provide truthful personal data during registration.

    • Some data can be updated online, while other data (used for identification) may only be changed via customer service (see contact under “Kontakt” at www.insic.de).

    • Further information on data processing is provided in the privacy policy at www.insic.de and www.insic.com.

  3. Services cannot be used until registration is completed.

  4. Users may request account blocking through customer service.

    • insic will prevent service use and store an encrypted dataset preventing re-registration for the legally required retention period.


§ 5 Email Address / Password

  1. During registration, Users set an email address and password.

    • insic recommends regular password changes and the use of complex characters.

  2. Users must keep passwords confidential and not share them with third parties.

    • Users are liable for costs and damages resulting from third-party use due to disclosure.

  3. insic is not liable for misuse caused by password disclosure.

  4. Users must promptly inform customer service of suspected or known misuse or loss of login data.


§ 6 User Obligations / Violations / Blocking

  1. Users confirm upon registration that they:

    • are at least 18 years old,

    • are not affected by gambling addiction (if using for gambling verification),

    • provide complete and truthful information,

    • use the system only for lawful services.

  2. Sharing login credentials is prohibited. Granting minors access is unlawful and potentially criminal.

  3. Users must notify insic if they become aware of unlawful services available via insic systems.

  4. In case of suspected violations or misuse, insic may block access immediately and inform service providers if necessary.

  5. Users are liable for all damages caused by violations of these obligations.

  6. Blocking also applies if insic is informed by third-party providers (e.g., gambling operators) according to applicable laws.


§ 7 Contract Duration / Termination

  1. The contract is indefinite and may be terminated by either party at any time without cause, effective at the end of the following month, by written notice or confirmed email.

  2. Extraordinary termination for good cause remains unaffected (e.g., violation of § 6).

  3. Right of Withdrawal (Distance Selling Law):

    • Users may withdraw within 14 days of conclusion without reason.

    • Withdrawal must be in text form (letter, fax, email).

    • Timely sending suffices to meet the deadline.

§ 8 Usage & Reproduction Rights

  1. For the plug-in version, insic grants a free, non-exclusive, non-transferable, time-limited right of use, limited to private use on one device.

  2. Copying beyond installation and backup, editing, or reverse engineering is prohibited, except for necessary decompilation to ensure interoperability where insic does not provide the required information.


§ 9 Warranty

  1. Insic Software: User rights under §§ 523 and 524 BGB apply.

  2. Age Verification Service (paid or free): Users have no additional warranty rights beyond contractual performance claims.


§ 10 Liability

  1. Insic Software: Liability according to § 521 BGB, with limitation to foreseeable damages. Product Liability remains unaffected.

  2. Other Services:

    • Full liability in cases of gross negligence or intent.

    • Full liability for injury to life, body, or health.

    • Full liability in cases of fraud or fraudulent concealment.

    • Liability also applies to essential contractual obligations (“cardinal duties”).

    • No liability for force majeure (e.g., strikes, government orders, supplier issues).

    • Claims expire after one year, except in cases of intent.


§ 11 Costs / Registration Without Partner

  1. Service use is free if registration is via an affiliated partner (partner covers costs).

  2. Direct registration with insic may require prior approval from customer service. insic reserves the right to refuse registrations not via a partner.


§ 12 Miscellaneous

  1. German law applies. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.

  2. Place of jurisdiction and performance is insic’s registered office.

  3. The contract is concluded in German. In case of discrepancies between translations, the German version prevails.
